Conneq” is a proprietary platform developed, owned and operated by Conneq, Inc. (“Conneq”, “we,” or “us” or “our”). We respect data privacy rights and are committed to protecting the personal information collected on our website https://www.conneq.com/ ("Website”) and Conneq mobile app (“App”).

This Privacy Policy (“Policy”) sets forth how we collect, use and protect the personal information collected on the Website and the App (collectively referred to as “Platform”), we render our services through the Platform ("Services”).

THIS PRIVACY POLICY IS TO BE READ ALONG WITH THE TERMS OF USE AVAILABLE AT: Terms of Use CAPITALIZED TERMS OTHER THAN THE ONES NOT DEFINED IN THIS PRIVACY POLICY, SHALL HAVE THE SAME MEANING ASCRIBED TO THEM IN THE TERMS OF SERVICE OF THE PLATFORM.

IF YOU ARE ACCESSING THE PLATFORM OR USING THE SERVICES ON BEHALF OF A THIRD PARTY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO USE THE PLATFORM OR AVAIL SERVICES AND TO BIND SUCH THIRD-PARTY TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND, IN SUCH AN EVENT YOUR USE OF THE PLATFORM AND OR THE SERVICES SHALL REFER TO USE BY SUCH THIRD PARTY.   • TYPES OF INFORMATION COLLECTED

    If you wish to get in touch with us through our ‘contact’ page or subscribe to our blogs/newsletters and submit your details through the ‘Become a Conneq Tech’ page on our Website; or otherwise avail our Services,  you are required to provide us with information including but not limited to the first name, last name, phone numbers, e-mail address, location, country/region, domains designation, candidate profile/resume and company’s name. For the sake of brevity, the aforementioned information shall be referred to as “Personal Information”.

    Customer representatives and users of our services may also be asked to provide contract signatures and additional company information for the purposes of processing invoices and payments and enabling business processes.

    Payment Information- You may elect to pay through our Platform, we may collect certain information such as name and email address to process your request. You will be required to provide certain payment information directly to our payment processing partners such as Stripe, including but not limited to your name, credit/debit card information. We do not access, store or collect your credit/debit card information or payment related sensitive data.

    Website and Social media accounts - We may also collect, store and use your Personal Information when you (1) access our social networking handles operated by us on Facebook, YouTube, Instagram, Reddit, Twitter, and/or LinkedIn (2) share our blogs through Facebook, Twitter, Reddit and/or Linkedin and (3) comment/ provide feedback/testimonials on such social networking handles.

  • ACCURACY OF INFORMATION

    User undertakes that he shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information and User Content shared/uploaded on the Platform whether of its own or any third party. In the event the User is sharing any Personal Information and User on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Information with the Company, obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Information shall be subject to the terms and conditions of this Privacy Policy.

  • TRACKING TECHNOLOGIES

    Cookies: We use cookies and similar tracking technologies to track user traffic patterns and hold certain registration information. Tracking technologies also used are beacons, tags and scripts to collect and track information and to improve and analyze our service. If you wish to not have the information these technologies collect, used for the purpose of serving you targeted ads the Help menu on the menu bar of most browsers will tell you how to prevent your browser from accepting new cookies, how to disable cookies altogether etc.

    • Analytical/performance cookies.
    • Targeting cookies.

    We use cookies to:

    • improve the user experience on the Platform
    • understand the usage based on the geographical area
    • understand the usage based on the demographics
    • understand and get usage patterns of the users

    The cookies will collect following information:

    • Clicks and scroll on the Website;
    • Visitor’s operating system, browser information, CPU, GPU; and
    • Information of Service Provider.

    Will disabling the cookies allow users to use the Platform? 

    We will not restrict the usage of the Platform if the cookies are disabled.

    We may also use your Personal Information collected to create aggregate anonymized data. We shall ensure that such anonymized data will not be directly identifiable to you or to the Personal Information shared with us. We may use this anonymized data for any purpose including but not limited to conduct research, analytical purposes, and to improve our Services. By using the Services and/or visiting our Platform, you provide us the right to use your Personal Information to create anonymized data and use it for our business purposes.

  • USE OF PERSONAL INFORMATION

    • To complete the registration/subscription formalities and to create an account for the User (“User Account”).
    • To provide User with the Services and to assist the User in the event the User needs any additional support.
    • Verification of certain information such as identity verification and log in credentials;
    • Providing Personal Data to any person or entity engaged by us to render services relating to payment, human resources, accounting etc. to support our business activities on a ‘need to know’ basis;
    • Carrying out activities connected with the running of our business such as personnel training, quality control and in connection with the transfer of any part of our business
    • To provide information about any new offerings/and or our periodic newsletter.
    • To assist User with technical difficulties that may arise in relation to User’s use and access of Platform.
    • Protecting our networks and security systems, including monitoring and detection of potential threats, such as hacking, virus dissemination and other security vulnerabilities;
    • For creation or development of business intelligence or data analytics in relation to the Services provided on the Platform
    • for internal record keeping and to comply with our legal or statutory obligations.
  • WHO DO WE DISCLOSE YOUR DATA TO?

    We do not sell, rent, share, distribute, lease or otherwise provide your Personal Information to third parties, without your prior consent. Keeping this in mind, we may disclose your Personal Information in the following cases:

    • Affiliates: We may provide your Personal Information to our affiliates to enable them to improve the Offerings, provide feedback and respond to their queries.
    • Administrators: We may provide access to User’s Personal information to any of our authorized administrators for an internal business purpose, who shall be under confidentiality obligations towards the same.
    • Service Providers: We may share your Personal Information with the service providers who work with us in connection with operating the Platform and/ or providing the Services. All such service provider is subject to stringent confidentiality restrictions consistent with this Privacy Policy.
    • Merger or Acquisition: We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Platform, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you.
    • Legal and Regulatory Authorities: We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Government authorities.

    If we outsource the processing of your Personal Information to third parties or provide your Personal Data to third party service providers, we will oblige those third parties to protect your Personal Data with appropriate security measures and prohibit them from using your Personal Data for their own purposes or from disclosing your Personal Data to others. 

  • HOW LONG WE RETAIN YOUR INFORMATION?

    • We endeavour to only collect such Personal Information that is necessary for the purposes indicated here, and to retain such data for no longer than is necessary for such purposes. The length of time Personal Information is retained, and criteria for determining that time, are dependent on the nature of the Personal Information and the purpose for which it was provided/ collected.
    • Subject to this section, we will try to delete your Personal Information upon reasonable written request for the same. Please note, however, that there might be latency in deleting Personal Information from our servers and backed-up versions might exist even after deletion.   • SECURITY 

    We will take all reasonable steps to ensure that Personal Information is stored in a secure environment and protected from unauthorized access, modification or disclosure. We strive to keep the Personal Data secure through implementation of the security practices and controls.

    Although we provide appropriate protections, we cannot warrant the security of any Personal Information transmitted as our systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take measures to mitigate any cyber security incidents. 

    User is responsible for all the actions that take place under the User Account. If User chooses to share User Account details and password or any Personal Information with third parties, the User is solely responsible for the same. If User loses control of the User Account, User may lose substantial control over its Personal Information and may be subject to legally binding actions. It is User’s responsibility to keep User’s password confidential and secure. 

  • ACCESSING AND MODIFYING PERSONAL INFORMATION

    In case, Users that avail our Services need to access, review, and/or make changes to the Personal Information, User may do so by requesting the Company’s admin or may do so by themselves on the User Account. 

  • YOUR RIGHTS

    You have the right to access your Personal Information in our possession, right to have us rectify or modify any such Personal Information, right to have us erase/delete your Personal Information, right to restrict us from processing such Personal Information, right to object to our use of your Personal Information, right to request to port your Personal Information, withdraw consent at any time where we are relying on consent to process your Personal Information, If you withdraw your consent, we may not be able to provide certain services to you. We may need to request specific information from you to help us confirm your identity or also contact you for further information in relation to your request. 

    In accordance with the industry best practices and privacy regulations worldwide we enable you to exercise the following rights:

    • Right to Access: As an Individual, you have the right to access your Personal Data being processed by us and understand the purpose, recipients to whom your Personal Data has been disclosed and the envisaged period of retention of Personal Information.
    • Right to Rectification: You have the right to rectify any inaccuracy in your Personal Data obtained and being processed by us.
    • Right to Erasure: You have the right to get your Personal Data erased on grounds of completion of purpose, withdrawal of consent, unlawful processing of data or pursuant to exercise of right to restrict processing or any statutory requirement.
    • Right to Object to Processing: You have the right to object to the processing of your Personal Data on grounds and if such Personal Data is being processed for direct marketing purposes.
    • Right to Withdraw Consent: You may at any time withdraw your consent by writing to us at the below mentioned e-mail address.

    Exercise of the above rights shall be in accordance with the applicable regulations.

    Exercising Your Rights: To exercise the rights described above, you must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data (this will require you to send an email from the account in question or login credentials), and (2) describes your request in sufficient detail to allow us to understand, evaluate, and respond to it.     We do not sell, rent, distribute, lease or otherwise provide your Personal Information to third parties, without your prior consent.

    Access: You have the right to request certain information about our collection and use of your Personal Data over the past 12 months. We will provide you with the following information:

    • The categories of Personal Data that we have collected about you;
    • The categories of sources from which that Personal Data was collected;
    • The business or commercial purpose for collecting or selling your Personal Data;
    • The categories of third parties with whom we have shared your Personal Data; and
    • The specific pieces of Personal Data that we have collected about you.
    • If we have disclosed your Personal Data for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third-party recipient.

    Deletion: You have the right to request that we delete the Personal Data that we have collected from you. Under the California Consumer Privacy Act of 2018 (“CCPA”), this right is subject to certain exceptions. For example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

    We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive, or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

    You may also authorize an agent (an “Authorized Agent”) to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to do, and we may request a copy of this written permission from your Authorized Agent when they make a request to exercise your rights on your behalf.

    We Will Not Discriminate Against You for Exercising Your Rights Under the CCPA

    We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our services, charge you different prices or rates, or provide you a lower quality of services if you exercise your rights under the CCPA. 

  • Third-Party Sites and Services

    Our Platform may contain links to other websites/ applications. As such, Conneq does not endorse and is not responsible for the privacy practices and protection of any information which you provide on such third party websites/ applications or the content of these third-party websites/ applications. We exercise no control over such other websites/ applications and how your information is stored, maintained or displayed by such third parties or on third-party websites/ applications. You should exercise caution and look at the privacy policy applicable to such websites/applications.

  • CHOICE AND OPT-OUT

    We may send you communications including but not limited to (a) notices about your use of our Services, Platform and Offerings, including those concerning violations of use, (b) updates, (c) promotional information regarding our Offerings, and (d) newsletters. You may opt out of receiving promotional emails and newsletters from us by following the unsubscribe instructions provided in those emails. Alternatively, you can opt out, at any time, by emailing privacy@conneq.com with your specific request.

  • LIMITATION OF LIABILITY

    USER EXPRESSLY UNDERSTANDS AND AGREES THAT THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, INFORMATION, DETAILS OR OTHER INTANGIBLE LOSSES (EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF THIS PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY HEREIN.

  • Children’s Privacy

    The Platform is not directed to children. We do not knowingly collect personally information from children under the age of 18 years without the prior, verifiable consent of his or her legal representative. If you, as a parent or guardian, become aware that your child has provided us with Personal Information without your consent, please contact us at privacy@conneq.com. If we become aware that a user is under the age of 13 and has provided us with Personal Information without verifiable parental consent, we will delete such information from our files.

  • GOVERNING LAWS AND DISPUTES

    This Privacy Policy will be governed by and construed under the laws of the California, excluding choice of law provisions. Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Policy may be brought against either of the Parties in any of the courts of California. Each of the Parties consent to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action or proceeding and waives any objection to venue laid therein.

  • CHANGES TO THIS POLICY

    Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which we may update from time to time. If we modify this Privacy Policy, we will make it available through the Platform and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change via email or through our Platform.
